4.1 Movere LLC as a Business Associate
When Movere LLC provides freight and logistics services to Covered Entities (as defined under HIPAA, including hospitals, clinics, laboratories, and healthcare providers), Movere LLC may function as a Business Associate as that term is defined under 45 CFR § 160.103. In this capacity, Movere LLC agrees to comply with all applicable requirements of the HIPAA Privacy Rule (45 CFR Part 164, Subpart E) and the HIPAA Security Rule (45 CFR Part 164, Subpart C), as well as the requirements of the Health Information Technology for Economic and Clinical Health (HITECH) Act.
4.2 Business Associate Agreement
Prior to handling any shipment that may involve Protected Health Information, Movere LLC requires the execution of a written Business Associate Agreement (BAA) with the applicable Covered Entity. The BAA sets forth the permitted uses and disclosures of PHI, the safeguards Movere will maintain, reporting obligations in the event of a breach, and the procedures for the return or destruction of PHI upon termination of the service relationship. Healthcare clients who have not yet executed a BAA should contact us immediately at Customer Support.
4.3 PHI Safeguards
In compliance with 45 CFR Parts 160 and 164, Movere LLC implements the following safeguards with respect to any PHI it may encounter in the course of its services:
- Administrative Safeguards: Designation of a Privacy Officer, workforce training on HIPAA requirements, documented policies and procedures, and regular risk assessments;
- Physical Safeguards: Controlled access to vehicles and facilities handling medical shipments, locked cargo compartments, and chain-of-custody documentation for all PHI-adjacent cargo;
- Technical Safeguards: Encrypted communication for any electronic transmission of PHI-related records, access controls on internal systems, and audit logging.
4.4 Limits on PHI Disclosure
Movere LLC will not use or disclose PHI in any manner that would violate the requirements of HIPAA or the applicable BAA. PHI will only be used to the extent necessary to perform the transportation services contracted for, to comply with legal obligations, or as otherwise expressly permitted under the BAA and applicable law. Movere LLC does not use PHI for marketing purposes under any circumstances.
4.5 Breach Notification
In the event of a discovered breach of unsecured PHI, Movere LLC will notify the applicable Covered Entity without unreasonable delay and in no case later than sixty (60) calendar days after discovery of the breach, in accordance with the requirements of 45 CFR § 164.410 and applicable state law.
